Terms of service
Terms and Conditions
1. General Information and Definitions
This document sets out the Terms and Conditions for using the site and for buying the products sold through it. Browsing the site and placing orders means you have read, understood and expressly accepted these Terms and Conditions.
- Seller: DRIVE BY WIRE SRL, a Romanian legal entity with its registered office in Câmpulung, Str. Mărăști nr. 4, building C2, 1st floor, Argeș County, tax identification number 49943332.
- Contact details: You can reach us by phone on +40779239301 or by e-mail at contact@letsrace.ro.
- Buyer: Any natural person (aged over 16) or legal entity that places an Order on the site.
- Order: An electronic document that acts as a form of communication between the Seller and the Buyer, through which the Buyer states the intention to purchase goods from the site.
- Products to order (Special order): Products that are not in the Seller's physical stock and that are imported or ordered from external suppliers solely on the Buyer's express request.
2. Online Sales Policy and Conclusion of the Contract
- Any customer may place an order. The Seller reserves the right to restrict a customer's access if that customer behaves abusively or repeatedly places false orders.
- When the contract is concluded: The e-mail generated automatically after an order is placed only confirms that the request was received and does NOT represent acceptance of the order or conclusion of the contract. The distance contract is considered concluded only when the Seller sends the Buyer the dispatch notification for the products, or a firm confirmation that a special order is being processed.
3. Prices, Human Error and Changes
- Prices shown on the site are expressed in RON and include all applicable taxes. Delivery costs are shown separately in the shopping cart.
- Human error and derisory prices: The Seller makes every effort to display correct information and prices. However, if through human or system error the price of a product is shown as derisory, disproportionately low compared with the real value of the product (under Article 1665 of the Romanian Civil Code), or visibly wrong, the Seller reserves the right to cancel that order, informing the customer as soon as possible, with no obligation to deliver at the wrong price.
- Supplier price changes: For products brought in on a Special order, the final price depends on the offers of external suppliers. If the purchase price has changed significantly between the moment the order was placed on the site and the moment it is processed, the Seller will communicate the new price. The Buyer is entitled to accept the new price or to cancel the order at no extra cost.
4. Special Orders and Advance Payment
- For products that are not in physical stock and require a special order with external manufacturers or suppliers, the Seller reserves the right to ask for an advance payment (partial or full) before processing the order.
- After the order is placed on the site, the Buyer will be contacted to confirm the details and will be issued an advance invoice.
- When processing starts and the delivery term: Placing the order with the external supplier and calculating the estimated delivery term begin only once the advance payment has actually been received in the Seller's account. Any delay in paying the advance invoice automatically pushes back the delivery term.
- The advance is not refunded: Because products brought in on a special order are imported at the Buyer's express request, if the Buyer decides to cancel the order after paying the advance and after the Seller has placed the external order, the amount paid as an advance will not be refunded, being retained as damages to cover the loss caused.
5. Delivery of the Products
- Delivery is made through courier companies.
- For products in our own stock, the estimated delivery term is 1 to 3 working days.
- For products brought in on a Special order, the delivery terms shown on the site are strictly indicative, as they depend on the logistics of the external manufacturers.
- The Seller cannot be held liable for delays caused by suppliers, by courier companies, by customs procedures or by events of force majeure. The risk of loss or damage to the products passes to the Buyer at the moment the Buyer takes physical possession of the goods.
6. What is Specific to Motorsport Products (Warranty and Use)
- Intended use: Certain performance parts sold on the site are intended solely for competition use, on track (track use / off-road only) and are not homologated for use on public roads (they hold no TÜV, RAR or similar certification), except where the product page clearly states otherwise. Fitting them to vehicles used on public roads is done on the Buyer's own responsibility.
- Warranty limits: The products carry the legal warranty of conformity. However, given the nature of motorsport, the warranty does not cover faults, premature wear or damage resulting from using the parts in racing, competitions or track days, from exceeding the recommended parameters, or from incorrect fitting carried out in unauthorised workshops.
7. Returns Policy and Exceptions
- Under Government Emergency Ordinance 34/2014, the consumer (natural person) has the right to withdraw from the contract within 14 calendar days of receiving products held in standard stock, without giving a reason. The cost of return shipping is borne by the Buyer.
-
Main exceptions to the right of return: Under the legislation in force, the following categories of product may NOT be returned:
- Parts and equipment brought in on a firm special order, which are not part of the shop's usual stock and were imported or ordered at the Buyer's express request.
- Products made to the consumer's specifications or clearly personalised.
- Products unsealed by the consumer that cannot be returned for reasons of health protection or hygiene.
- Reduction in value: The Buyer is responsible for any reduction in the value of the products resulting from handling beyond what is needed to establish the nature, characteristics and functioning of the products. If the returned product shows signs of wear or of having been fitted, the Seller reserves the right to withhold part of the value of the product.
8. Force Majeure and Dispute Resolution
- Neither party will be liable for failing to perform its obligations if that failure is due to an event of force majeure.
- Any dispute will be settled amicably. If that is not possible, the dispute will be settled by the competent courts in Romania.
